The effects of disability, age or illness can make it impossible for a person to manage his/her affairs on their own. Addressing this situation, and offering the support the incapacitated adult needs, often requires setting up a guardianship. Arkansas has two types of guardianships for adults:
A guardianship can be temporary or permanent, and the scope depends upon the needs of the person for whom it is sought — known as the ward. In order to establish a guardianship, a court must rule that the person is mentally incompetent, or so impaired that they are incapable of making or communicating decisions related to health, personal care and/or finances. Unfortunately, parents are not always able or willing to care for their children, whether due to illness, mental or physical disability, substance abuse or addiction, incarceration, abandonment or death. In these circumstances, guardianship powers may be granted to a qualified adult, who is then authorized to make major decisions on the child’s behalf and manage their ward’s finances. One person may be given both responsibilities or they may be divided and handled by two separate guardians.
